Financial intermediary services in South Africa

Registration, licence and cover

Orinoco Capital (Pty) Ltd is a private company registered in South Africa, holding a Financial Services Provider (FSP) Category 1 license (FSP 51913) issued by the FSCA. CIPC Registration number 2021/704761/07. Orinoco acts solely as an intermediary service and does not provide any advice according but not limited to the definition of FAIS Act.

Authorised Financial Services Provider (FSP 51913). Orinoco Capital holds Professional Indemnity and Fidelity Insurance coverage to protect client interests in accordance with South African regulations.

Who issues the product

Orinoco Capital is not the market maker and/or product issuer and acts solely as an intermediary in terms of but not limited to the FAIS Act definition between the client and Octa. Octa is the market maker and product issuer for all Orinoco clients therefore, Orinoco is not the principal or the counterparty in any of the transactions. The company acts solely as a financial intermediary, and does not execute trades itself but only facilitates client access to the broker platform owned by broker*. By opening an account, you will be registered with Octa Markets Incorporated which is authorized incorporated under the laws of Saint Lucia, with its head office located at: Ground Floor, Rodney Court Building, Rodney Bay, Gros-Islet, Saint Lucia.

*Orinoco operates as the exclusive intermediary of Octa Markets Inc, and does not enter into similar agreements with third parties during the term of the partnership.

What Orinoco is responsible for

Orinoco remains responsible for the intermediary services that it provides, including client onboarding and account-opening facilitation; customer due diligence, screening, ongoing monitoring and other applicable AML/CFT obligations; transmission of client information and instructions; ongoing client servicing and communications; complaints handling; and compliance with the FAIS Act, FICA, POPIA, applicable FSCA requirements and the conditions of its FSP licence.

The company does not engage in trading, or manage margin requirements on its side — all trading functions are performed by broker. Orinoco does not provide clients with financial advice.
